Privacy policy

Processing of personal data on this website and in communications with the firm, under Brazilian Law No. 13,709/2018 (General Data Protection Law, LGPD).

Data processed when visiting the website

The website has no forms, sets no cookies and loads no trackers, pixels, embedded maps or audience analytics tools. Images and scripts are served from the website’s own domain, and the fonts are those installed on the visitor’s device. For this reason there is no cookie consent notice.

The hosting provider logs technical data for each visit, such as IP address, date, time and the page requested, in order to deliver the content and protect the website against abuse. The legal basis is the controller’s legitimate interest (LGPD, art. 7, IX).

Email messages

Data sent to the firm by email is processed in order to respond and, if the firm is engaged, to provide the service. The legal bases are compliance with a legal or regulatory obligation, the performance of a contract or of preliminary procedures at the data subject’s request, and the regular exercise of rights in judicial, administrative or arbitral proceedings (LGPD, art. 7, II, V and VI). Any sensitive personal data provided is processed under art. 11, II, a and d, of the same law.

Correspondence with the lawyer is protected by inviolability and professional secrecy (Law No. 8,906/1994, art. 7, II; Code of Ethics and Discipline of the OAB, arts. 35 to 38).

Processors and international transfer

The hosting and email providers process this data on the firm’s behalf, as processors (LGPD, art. 5, VII), and may store it on servers located outside Brazil. In that case, the international transfer is subject to art. 33 of the LGPD.

Retention

Data is retained for as long as the purpose that justified the processing lasts and, once that purpose ends, for the period needed to comply with legal or regulatory obligations and for the regular exercise of rights, taking into account the applicable limitation periods (LGPD, arts. 15 and 16, I).

Data subject rights

Data subjects may request confirmation that processing takes place, access, correction, anonymisation, blocking or deletion of unnecessary or excessive data, portability, and information about the entities with which the data has been shared (LGPD, art. 18). Requests should be sent to contato@bourgeois.adv.br and are answered within the periods set by art. 19 of the LGPD. Data subjects may also petition the National Data Protection Authority (Autoridade Nacional de Proteção de Dados) (art. 18, § 1).

Controller

The controller is Pedro Bourgeois Gomes, a lawyer registered with the OAB/RJ under No. 275.544, with professional address at Rua Jardim Botânico, 635, sala 201, Jardim Botânico, Rio de Janeiro, RJ, Brazil.
